No criminal charges in fatal container crash on Route 3 in Rutherford

UPDATE: Rutherford police have issued several summonses to a Clifton trucker and his employer in connection with the death of a driver crushed by a container that fell onto his car on Route 3 earlier this month.

Mutakabbir Ali, 50, received summonses for careless driving, carrying cargo exceeding the height limit, “loading to spill” and obstruction of view, Capt. Patrick Feliciano told CLIFFVIEW PILOT this afternoon.

Police also issued summonses for having an unsafe vehicle and hazardous tires to the owner of the 1992 Peterbilt tractor, Parkway Iron & Metal Co. Inc. of Clifton.

James Hart III, 39, of Westchester, was behind the wheel of a 2014 Honda in the westbound highway’s furthest right lane on June 8 when the container hit the Orient Way overpass in the next lane and landed on his car.

Hart was pronounced dead at the scene a little over an hour later.

County authorities haven’t pursued criminal charges following an investigation by the Bergen County Fatal Accident Investigation Unit, leaving it to local police to issue summonses.
